Terms of Use
These terms are between you and Eric Pelland, publishing as JustANerd (“we”), and cover the Fathom Station app and fathomstation.com. By playing you agree to them. If you got the game from the Apple App Store, Apple's Standard End User License Agreement also applies; if you got it from Google Play, the Google Play Terms of Service also apply.
1. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to download and play Fathom Station for your own non-commercial entertainment on devices you own or control. Please don't copy, resell, reverse-engineer or modify the game, or use cheats, bots or exploits that interfere with how it works. Making videos, streams and screenshots of the game is welcome.
2. Pearls, coins and other virtual items
- In-game currencies (coins, Research Points, pearls) and items (room themes, sub liveries, hats, passes) are a limited licence to use content inside the game. They have no real-world value, can't be exchanged for money and can't be transferred or sold outside the game.
- Purchases are processed by Apple or Google. Refunds are handled under their policies: request them through the store you bought from.
- One-time purchases (such as the Starter Bundle and the Ad-Free Pass) can be restored from the Shop on the same store account. Consumables (pearl packs) are used up and can't be restored if your save is deleted.
- Your progress is saved on your device. If you delete the game or your save, or lose your device, progress can't be recovered by us.
3. Ads
The game can offer optional rewarded videos from third parties. We aren't responsible for the content of third-party ads or the sites they link to.
4. Updates and availability
We may update, change or rebalance the game, add or remove features, or, with reasonable notice where possible, stop offering it. Some updates may be required to keep playing.
5. Our content
The game, its art, music, characters, creatures and this website are owned by us and protected by copyright and other laws. Fonts are used under the SIL Open Font License.
6. Disclaimer and limitation of liability
The game is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim implied warranties and aren't liable for indirect, incidental or consequential losses, or for loss of in-game progress or items. Our total liability to you is limited to the amount you paid for the game and in-game purchases in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that can't be excluded.
7. Ending these terms
You can stop at any time by deleting the game. We may suspend or end your licence if you seriously break these terms.
8. General
If part of these terms turns out to be unenforceable, the rest still applies. We may update these terms; the date at the top shows the latest version, and continuing to play after a change means you accept it. Questions? justanerdgaming@proton.me.
